1. Acceptance of Terms
By accessing or using the Tejas Clinic website, scheduling appointments, communicating with us via any channel (phone, email, text, patient portal), or receiving services from our clinic, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services. These Terms apply to all patients, website visitors, and users of our digital services.
2. Our Services
Tejas Clinic provides internal medicine, primary care, chronic disease management, in-house laboratory services, telehealth consultations, and preventive care at our location in Frisco, TX. Our website allows you to learn about our services, request appointments, access health information, and communicate with our care team. All services are subject to availability, clinical discretion, and applicable laws.
3. Medical Disclaimer
The content on our website — including text, graphics, health information, and educational materials — is provided for informational purposes only and does not constitute medical advice, diagnosis, or treatment.
- The information is not a substitute for professional medical advice from a qualified healthcare provider.
- Always seek the advice of your physician with any questions regarding a medical condition.
- Never disregard professional medical advice or delay seeking it because of something you read on our website.
- If you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency room.

4. Appointment Requests & Scheduling
Submitting an appointment request through our website, phone, or any other channel does not guarantee an appointment. All requests are subject to review and confirmation by our patient coordination team.
By submitting an appointment request, you agree that:
- The information you provide is accurate and complete.
- Our team will contact you to confirm, reschedule, or discuss your appointment within 2 business hours.
- You are responsible for attending confirmed appointments or providing at least 24 hours' notice for cancellations.
- Repeated no-shows (3 or more within a 12-month period) may result in scheduling restrictions or dismissal from the practice, at our discretion.
- Same-day and urgent appointments are subject to availability and clinical prioritization.
Cancellation & No-Show Policy
- Cancellations with less than 24 hours' notice may be subject to a cancellation fee.
- No-show fees may apply for missed appointments without prior notice.
- Fee amounts will be communicated to you at the time of scheduling and are posted in our office.
5. Patient Responsibilities
As a patient of Tejas Clinic, you agree to:
- Provide accurate and complete health history, medication lists, allergy information, and personal details.
- Inform us promptly of changes to your insurance, contact information, or health status.
- Follow the treatment plans and recommendations of your healthcare provider, or discuss alternatives openly.
- Take an active role in your own healthcare decisions.
- Arrive on time for scheduled appointments. Patients arriving more than 15 minutes late may need to be rescheduled.
- Treat our physicians, staff, and other patients with respect and courtesy. Abusive, threatening, or disruptive behavior will not be tolerated and may result in dismissal from the practice.
- Pay for services rendered in accordance with our billing policies.
- Notify us if you do not understand your diagnosis, treatment plan, or billing statement.
6. Insurance, Billing & Payment
Insurance
- Tejas Clinic accepts most major insurance plans. It is your responsibility to verify your coverage before your visit.
- You are responsible for understanding your benefits, including copays, deductibles, coinsurance, and coverage limitations.
- We will submit claims on your behalf but cannot guarantee payment from your insurance company.
- If your insurance denies a claim, you are responsible for the balance unless otherwise negotiated.
Payment
- Copays and any known patient responsibility are due at the time of service.
- We accept cash, credit cards, debit cards, and HSA/FSA cards.
- For uninsured patients, we offer transparent cash-pay pricing. Ask our front desk for a fee schedule.
- Outstanding balances not paid within 90 days may be referred to a collections agency after written notice.
- We offer payment plans for qualifying patients. Discuss options with our billing team.
Surprise Billing Protections
As required by the No Surprises Act (effective January 2022), you have the right to receive a Good Faith Estimate of expected charges for scheduled services if you are uninsured or choose not to use your insurance. We comply with all federal and Texas state surprise billing protections.
7. Telehealth Services
Tejas Clinic offers telehealth consultations for eligible patients. By using our telehealth services, you acknowledge and agree that:
- Telehealth is conducted via HIPAA-compliant, encrypted video platforms.
- Telehealth has inherent limitations compared to in-person visits, including the inability to perform a physical examination.
- Technical difficulties (internet connectivity, audio/video quality) may occur and are not within our control.
- Your provider may determine that an in-person visit is medically necessary and redirect your care accordingly.
- You are responsible for ensuring a private, quiet environment during your telehealth visit.
- Telehealth services are provided in compliance with the Texas Occupations Code Chapter 111 (Texas telemedicine regulations).
- Prescribing controlled substances via telehealth is subject to DEA and Texas Medical Board regulations.
- Telehealth visits are billed at the same rate as in-person visits and are subject to the same insurance and payment policies.
8. Patient Communications
Consent to Communications
By providing your contact information, you consent to receive communications from Tejas Clinic related to your care, including:
- Appointment confirmations and reminders (phone, text, email)
- Test result notifications
- Prescription and medication reminders
- Billing statements and payment reminders
- Clinic updates and operational notices (e.g., holiday hours, closures)
Opting Out
You may opt out of non-essential communications at any time by contacting our office, replying STOP to text messages, or using the unsubscribe link in emails. Note: Opting out of communications does not affect communications that are clinically necessary or legally required.
Patient Portal
- Your patient portal account is for your personal use only. Do not share your login credentials.
- Messages sent through the patient portal are part of your medical record.
- The patient portal should not be used for emergencies or urgent medical concerns.
- We aim to respond to portal messages within 1-2 business days during regular business hours.
Recording Policy
- Phone calls to our office may be recorded for quality assurance and training.
- You may not record in-person visits, telehealth sessions, or phone calls without the consent of all parties, in accordance with Texas Penal Code § 16.02 (one-party consent).
9. Patient Portal & Digital Services
Account Access
- You are responsible for maintaining the confidentiality of your portal login credentials.
- Notify us immediately if you suspect unauthorized access to your account.
- We may suspend or terminate portal access for security reasons or Terms violations.
Proxy Access
- Parents/legal guardians may request proxy access to a minor's portal account.
- You may designate an authorized representative for portal access by completing a written authorization form.
- Proxy access for minors may be modified when the patient reaches age 18, in accordance with Texas law.
Data Accuracy
- You are responsible for reviewing the information in your portal and notifying us of any errors.
- While we strive for accuracy, the portal may not reflect real-time updates. Always confirm critical information with our office.
10. Prescription & Medication Policies
- Prescription refill requests should be submitted at least 3-5 business days before your medication runs out.
- Controlled substance prescriptions are subject to Texas Prescription Monitoring Program (PMP) requirements and DEA regulations.
- We do not prescribe controlled substances via telehealth for new patients without an initial in-person evaluation, except as permitted by law.
- Prescription requests received after hours or on weekends will be processed on the next business day.
11. Medical Records
- You have the right to access your medical records as described in our Privacy Policy.
- Record requests are processed within 15 business days (30 days maximum as permitted by HIPAA).
- A reasonable fee may be charged for record copies, not to exceed limits set by Texas law.
- We maintain medical records in accordance with Texas state retention requirements (minimum 7 years from last treatment).
- Records may be transferred to another provider at your written request.
12. Intellectual Property
All content on the Tejas Clinic website — including text, graphics, logos, images, videos, and software — is the property of Tejas Clinic or its content providers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
The "Tejas Clinic" name, logo, and associated branding are trademarks of Tejas Clinic. Unauthorized use is prohibited.
13. Website Use Restrictions
When using our website, you agree not to:
- Use the website for any unlawful purpose or in violation of applicable laws.
- Attempt to gain unauthorized access to our systems, networks, or patient records.
- Transmit viruses, malware, or any harmful code.
- Interfere with or disrupt the website's functionality or security.
- Submit false, misleading, or fraudulent information through any forms.
- Use automated tools (bots, scrapers, crawlers) to collect data from our website.
- Impersonate another person or entity.
- Use the website to transmit unsolicited commercial communications.
We reserve the right to block or restrict access for violations of these restrictions.
14. Third-Party Links & Integrations
Our website may contain links to third-party websites and services, including insurance portals, pharmacy services, lab result portals, and health information resources. Tejas Clinic does not endorse, control, or assume responsibility for the content, privacy practices, or terms of these external services. Use of third-party services is at your own risk.
15. Limitation of Liability
To the fullest extent permitted by Texas law:
- Tejas Clinic and its physicians, staff, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or digital services.
- Our total liability for any claim related to the website shall not exceed $100.
- This section does not limit liability for medical malpractice claims, which are governed by the Texas Medical Liability Act (Texas Civil Practice & Remedies Code, Chapter 74).
- We are not liable for damages resulting from service interruptions, data loss, unauthorized access caused by your failure to maintain credential security, or third-party service failures.
16. Disclaimer of Warranties
Our website and digital services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the website will be uninterrupted, error-free, secure, or free of harmful components. This disclaimer applies to the website and digital tools only — clinical services are provided according to applicable standards of care.
17. Indemnification
You agree to indemnify and hold harmless Tejas Clinic, its physicians, staff, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your violation of these Terms, your misuse of our website or services, or any inaccurate information you provide.
18. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions.
- Any disputes arising from these Terms shall be resolved in the state or federal courts located in Collin County, Texas.
- Before filing any legal action, you agree to attempt to resolve disputes through informal negotiation by contacting our office in writing.
- Medical malpractice claims are subject to the notice and procedural requirements of the Texas Medical Liability Act.
19. Termination of Services
By the Patient
You may terminate your patient-provider relationship at any time by notifying our office in writing. We will provide a reasonable transition period and assist with transferring your records to a new provider.
By Tejas Clinic
We may terminate the patient-provider relationship for reasons including but not limited to:
- Repeated no-shows or cancellations
- Failure to pay outstanding balances
- Abusive or threatening behavior toward staff or other patients
- Failure to follow treatment plans or medical advice to an extent that compromises your care
- Fraudulent insurance or identity information
In all cases, we will provide written notice and a reasonable period (at least 30 days) for you to find a new provider, except in cases involving immediate safety concerns. Emergency care will not be withheld during the transition period.
20. Accessibility
Tejas Clinic is committed to making our website and services accessible to all individuals, including those with disabilities. If you experience difficulty accessing any part of our website, please contact us and we will work to provide the information you need in an accessible format.
21. Changes to These Terms
We may modify these Terms at any time. Changes will be posted on this page with an updated effective date. Material changes will be communicated through our patient portal, email, or posted notice in our clinic. Your continued use of our website or services after changes constitutes acceptance of the revised Terms.
22. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
